GunTomo Terms of Use

The short version

Using GunTomo means accepting these terms and Apple's standard EULA. Subscriptions renew through your Apple Account until you cancel them in Settings, at least 24 hours before renewal. Refunds go through Apple.

1. Agreement

  • These terms are an agreement between you and Lucernel LLC for your use of GunTomo. By downloading or using the app you accept them.
  • Apple's Standard Licensed Application End User License Agreement (https://www.apple.com/legal/internet-services/itunes/dev/stdeula/) also applies. Where the two differ, these terms add to it for GunTomo.

2. The app

GunTomo is an iPhone app for Gundam Card Game card scanning, market prices and collection tracking. Features may change as the app is updated.

3. License

Lucernel gives you a personal, non-transferable license to use the app on Apple devices that you own or control, as allowed by the App Store Usage Rules.

4. Subscriptions and purchases

  • GunTomo Pro is available as a weekly or yearly subscription. Prices and renewal terms are shown in the app before purchase.
  • Payment is charged to your Apple Account when you confirm the purchase.
  • A subscription renews automatically unless it is turned off at least 24 hours before the end of the current period. Your account is charged for the renewal within the 24 hours before the period ends.
  • You can manage or cancel subscriptions in the Settings app: tap your name, then Subscriptions. Cancelling stops the next renewal; access continues until the end of the period you paid for.
  • If a free trial is offered, any unused part of it ends when you buy a subscription.
  • Restore Purchases in the app brings back what you bought on another device with the same Apple Account.

5. Refunds

  • Purchases are processed by Apple, not by Lucernel.
  • To ask for a refund, use reportaproblem.apple.com.

6. Acceptable use

Do not misuse the app: do not break the law with it, try to get around its protections or payments, copy or resell it, or interfere with its services.

7. Your records

What you record in GunTomo is yours. Lucernel claims no ownership of it and cannot read it.

8. Prices and trademarks

  • Prices are reference values from third-party market data. They can be delayed or wrong and are not an offer to buy or sell.
  • GunTomo is an independent app. It is not affiliated with, endorsed or sponsored by Bandai Namco or Sunrise. Card names and artwork belong to their owners.

9. Third-party services

  • Apple App Store.
  • Apple iCloud / CloudKit (optional).
  • RevenueCat.
  • PostHog.
  • TCGCSV (TCGplayer price data).
  • GCG API card dataset (GitHub).
  • European Central Bank exchange rates.
  • Those services follow their own terms. Lucernel is not responsible for their availability.

10. Apple

  • These terms are between you and Lucernel, not Apple. Lucernel, not Apple, is responsible for the app and its content.
  • Apple has no obligation to provide maintenance or support for the app. For support, write to [email protected].
  • If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any. To the extent allowed by law, Apple has no other warranty obligation for the app.
  • Lucernel, not Apple, handles any claims about the app, including product liability, legal or regulatory compliance, consumer protection and intellectual property claims.
  • You confirm that you are not in a country under a U.S. Government embargo and are not on a U.S. Government list of prohibited or restricted parties.
  • Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

11. Changes and availability

We may update the app and these terms. When the terms change, the date at the top changes too. We may stop offering the app; if that happens, we will tell you in advance where possible.

12. No warranty

The app is provided as is and as available. Lucernel does not promise that it will be uninterrupted, error-free or right for every situation.

13. Limitation of liability

To the extent allowed by law, Lucernel is not liable for indirect, incidental, special, consequential or punitive damages from your use of the app. Nothing in these terms limits rights you have as a consumer that cannot be limited.

14. Governing law

These terms are governed by the laws of the State of Wyoming, where Lucernel LLC is organized, and by applicable United States federal law, without regard to conflict-of-law rules. Consumer protection laws of the country where you live still apply.
